PLEASE READ CAREFULLY. These Terms of Use ("Terms") govern your access to and use of services, websites, applications, and Digital Guest Guides™ provided by JH Concierge, LLC. By accessing or using any of our services, you agree to be bound by these Terms.
Welcome. These Terms of Use ("Terms") constitute a legally binding agreement between you and JH Concierge, LLC, a Florida Limited Liability Company ("JH Concierge," "we," "us," or "our"). These Terms govern your access to and use of any services, products, websites, mobile applications, Digital Guest Guides™, or related platforms operated by JH Concierge (collectively, the "Services").
These Terms are organized into two parts:

Property owners, hosts, hotel operators, and businesses
JH Concierge provides Clients with digital guest experience tools, including but not limited to: custom Digital Guest Guides™, branded direct booking websites, hotel concierge platforms (Lobby™), partner network placement, content updates, and related support services. The specific Services purchased are defined by the tier selected at the time of subscription.
Clients may select from available service tiers (e.g., Priority, Priority+, Essential, Signature, Estate). Tier features and inclusions are described in your engagement agreement at the time of purchase. JH Concierge reserves the right to modify tier offerings with thirty (30) days' written notice. Clients may upgrade or downgrade tiers at any time, with prorated billing effective the following billing cycle.
Clients agree to pay all fees associated with their selected tier, including:
JH Concierge currently accepts Zelle and Venmo for payment. Additional payment methods may be added at our discretion. All payments must be received in full and on time. No work shall commence until initial payment is received.
Monthly subscription fees are billed in advance on the same date each month, beginning the date initial Services are activated. Payment is due within five (5) business days of the billing date. Late payments may result in service suspension. Services suspended for non-payment may be reinstated upon receipt of all outstanding fees plus any applicable reinstatement fee.
All fees paid to JH Concierge are non-refundable. This includes monthly subscription fees, build fees, website fees, and any other payments. Clients may cancel future billing at any time pursuant to Section A3, but will not receive refunds for periods already billed.
Subscriptions operate on a month-to-month basis with no minimum commitment. Either party may cancel the subscription at any time by providing written notice (email to info@jonathanshouse.com is sufficient). Cancellation takes effect at the end of the current billing cycle.
JH Concierge reserves the right to terminate Services immediately, without refund, for any of the following:

Clients retain ownership of all property photos, descriptions, branding elements, and other content they provide to JH Concierge ("Client Content"). By providing Client Content, Clients grant JH Concierge a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display the Client Content solely for the purpose of providing Services.
All aspects of the Services not constituting Client Content — including software, design, code, templates, layouts, user interface elements, the Digital Guest Guide™ format and structure, curated local recommendations (where created by JH Concierge), brand assets, trademarks, trade dress, and underlying technology — are and remain the exclusive intellectual property of JH Concierge, LLC ("JH Concierge Property"). Clients receive a limited, revocable, non-transferable license to use JH Concierge Property solely in connection with the Services and only during an active paid subscription.
Upon cancellation or termination of Services, Clients shall:
Clients may retain Client Content (their own photos, descriptions, etc.) but may not retain or use the JH Concierge structure, format, design, or implementation.
JH Concierge will use commercially reasonable efforts to maintain Services in working order. We do not guarantee uninterrupted availability, error-free operation, or compatibility with all third-party platforms. Scheduled maintenance and updates may occur from time to time. JH Concierge is not responsible for outages, errors, or service interruptions caused by third-party platforms (e.g., Airbnb, VRBO, Hospitable, Netlify, hosting providers, internet service providers).
Visitors and guests accessing Digital Guest Guides™
If you are accessing a Digital Guest Guide™ as a guest of a property, you are authorized to use the Guide solely:
Access to a Digital Guest Guide™ does not transfer any ownership rights and may be revoked at any time.
You agree NOT to:
Digital Guest Guides™ may contain recommendations for local businesses, restaurants, activities, and services. These recommendations are provided for convenience only. JH Concierge does not operate, control, endorse the safety of, or guarantee the quality of any third-party businesses. Your interactions with third-party businesses are solely between you and that business. JH Concierge is not liable for any goods, services, injuries, or losses arising from third-party interactions.
The Digital Guest Guide™ may contain house rules established by the property owner or operator. These rules are set by the host, not by JH Concierge. Failure to comply with house rules may result in early termination of your stay, additional charges, or legal action by the host. Any disputes regarding house rules, stay quality, or property condition must be resolved directly with the property owner or the booking platform through which you reserved.
Your use of the Digital Guest Guide™ is subject to our Privacy Policy, which describes what information may be collected and how it is used.
Applicable to all users — Clients and End Users alike
All content, design, structure, software, and technology comprising the Services — including but not limited to the Digital Guest Guide™ format, Lobby™ platform, JHC™ brand, layouts, user interface, navigation systems, code, written content created by JH Concierge, and curated recommendations — constitute valuable intellectual property of JH Concierge, LLC, protected by U.S. and international copyright, trademark, trade dress, and trade secret laws.
The following are trademarks of JH Concierge, LLC, whether registered or claimed under common law:
Unauthorized use of these marks, or any confusingly similar marks, is strictly prohibited.
Without limiting the foregoing, you specifically agree that you will not:
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. JH Concierge expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, and uninterrupted operation. JH Concierge does not warrant that the Services will meet your requirements or that the Services will be free of errors, viruses, or other harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JH CONCIERGE, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, BOOKINGS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
JH Concierge's total aggregate liability for any claim arising out of or related to these Terms or the Services shall not exceed the greater of (a) one hundred U.S. dollars ([as detailed in engagement agreement]), or (b) the total fees paid by you to JH Concierge during the three (3) months preceding the claim.
You agree to defend, indemnify, and hold harmless JH Concierge, LLC, its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of such courts.
The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees and costs.
JH Concierge may modify these Terms at any time. Material changes will be communicated by updating the "Last Updated" date at the top of this document and, for Clients, by reasonable notice (e.g., email). Continued use of the Services after the effective date of modified Terms constitutes acceptance of the modified Terms.
Entire Agreement. These Terms, together with any tier-specific terms agreed at the time of subscription, our Privacy Policy, and our Cookie Notice, constitute the entire agreement between you and JH Concierge regarding the Services.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
No Waiver. JH Concierge's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment. You may not assign or transfer these Terms or any rights hereunder. JH Concierge may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure. Neither party shall be liable for any failure to perform due to causes beyond its reasonable control, including acts of God, natural disasters, government actions, internet outages, or third-party platform failures.
